Driving Under the Influence Jefferson County, MO

Technically, driving under the influence (DUI) is not a charge in Missouri.  Different states call their driving while intoxicated laws different names, and Missouri has only driving while intoxicated, which includes alcohol-impaired driving and drug-impaired driving.  People still refer to these phrases interchangeably.  Although some people may call their DWI charge a DUI when it’s alcohol-related, many refer to a DUI as driving under the influence of drugs.  Driving under the influence of drugs is becoming a more common charge, perhaps because of the legality—for certain purposes—of marijuana.

Generally, these cases are more difficult for prosecutors to prove because they have to prove the arrested drivers were impaired by drugs at the time they were driving.  For instance, although a blood or urine test may show the presence of marijuana or another drug, it is not direct proof the drug was impairing the arrested driver at the time he or she was driving.  Additionally, there are certain field sobriety tests aimed at detecting drug-impaired driving, and there are a limited number of officers trained to conduct these tests.  These officers are call Drug Recognition Experts (DREs).  If an officer without DRE training or certification conducts the tests, a good DUI attorney will take advantage of that and potentially destroy the prosecutor’s case.
